September Discipline and Administrative Actions

The following captures disciplinary and administrative actions across the 366th Fighter Wing for September 2016:

Article 15s:

- A Tech. Sgt. received an Article 15 for wrongfully using marijuana. The member was punished with a reduction in rank to E-5 and a reprimand for violating Article 112a, UCMJ, wrongful use of marijuana.

- An Airman 1st Class received an Article 15 for grabbing and choking another member in the workplace. The member was punished with a reduction in rank to E-2 and a reprimand for violating Article 128, UCMJ, assault consummated by a battery.

- An Airman 1st Class received an Article 15 for a Health Insurance Portability and Accountability Act (HIPAA) violation. The member was punished with a suspended reduction in rank to E-2, 5 days extra duty and a reprimand for violating Article 92, UCMJ, dereliction of duty.

Administrative Demotions:

- A Senior Airman was demoted to Airman First Class for a third failure of the fitness assessment.

-A Tech. Sgt. was demoted to Staff Sgt. for driving under the influence (DUI). Member was arrested off-base and charged with DUI after failing Field Sobriety Tests (FSTs) and having a breath alcohol level of 0.169/0.179. The member pled guilty to DUI and received a withheld judgment (similar to suspended conviction). Member was sentenced to 5 days jail with credit for 3 days, one year unsupervised probation and a fine of $750.00. The member also lost off-base driving privileges for 180 days.
