Justice report Published July 21, 2009 By 366th Fighter Wing Judge Advocates Office MOUNTAIN HOME AIR FORCE BASE, Idaho -- The 366th Fighter Wing Judge Advocates Office recently released the following information on violations of the Uniform Code of Military Justice from May 1 to June 30. Articles 15 An airmen from the 366th Aircraft Maintenance Squadron received nonjudicial punishment consisting of 45 days extra duty and 45 days restriction for being late to work and writing bad checks. An airman from the 366th AMXS received nonjudicial punishment consisting of reduction to the grade of airman basic, 45 days extra duty and a reprimand for wrongful sexual contact and failing to obey a lawful order. An airman from the 366th Component Maintenance Squadron received nonjudicial punishment consisting of 15 days extra duty and 21 days restriction for providing alcohol to a minor. An airman from the 366th Logistics Readiness Squadron received nonjudicial punishment consisting of reduction to airman basic, 30 days extra duty, an additional 15 days suspended extra duty and a reprimand for sleeping on duty. An airman from the 366th LRS received nonjudicial punishment consisting of suspended reduction to airman basic, 15 days extra duty, an additional 15 days suspended extra duty and a reprimand for sleeping on duty. An airman from the 366th Force Support Squadron received nonjudicial punishment consisting of 15 days extra duty and a reprimand for leaving their place of duty. An airman 1st class from the 366th AMXS received nonjudicial punishment consisting of reduction to airman, 15 days extra duty and a reprimand for using marijuana. An airman 1st class from the 366th AMXS received nonjudicial punishment consisting of reduction to airman, 14 days extra duty and a reprimand for government travel card misuse. An airman 1st class from the 366th Civil Engineer Squadron received nonjudicial punishment consisting of suspended reduction to airman, 30 days restriction and a reprimand for underage drinking. An airman 1st class from the 366th CMS received nonjudicial punishment consisting of reduction to airman basic for using marijuana. An airman 1st class from the 366th FSS received nonjudicial punishment consisting of reduction to airman, suspended reduction to airman basic, 30 days extra duty, forfeiture of $500 pay per month for one month and a reprimand for lying to an noncommissioned officer and underage drinking. A senior airman from the 366th AMXS received nonjudicial punishment consisting of reduction to airman 1st class, 15 days extra duty and a reprimand for driving on base without privileges and failing to turn a speeding ticket into his first sergeant. A senior airman from the 366th LRS received nonjudicial punishment consisting of reduction to airman 1st class, suspended reduction to airman, 15 days extra duty, an additional 15 days suspended extra duty, suspended forfeitures of $500 pay per month for one month and a reprimand for disrespecting an noncommissioned officer and refusing to obey a lawful order. A senior airman from the 366th Operations Support Squadron received nonjudicial punishment consisting of reduction to airman 1st class and 14 days extra duty for government travel card. A senior airman from the 726th Air Control Squadron received nonjudicial punishment consisting of reduction to airman 1st class and a reprimand for adultery. A staff sergeant from the 366th Aerospace Medicine Squadron received nonjudicial punishment consisting of suspended reduction to senior airman and a reprimand for stealing from the base exchange. A staff sergeant from the 366th Security Forces Squadron received nonjudicial punishment consisting of reduction to senior airman, 30 days extra duty, suspended forfeiture of $300 pay per month for two months and a reprimand for child endangerment. A captain from the 366th Medical Operations Squadron received nonjudicial punishment consisting of forfeiture of $1,500 pay per month for one month, an additional suspended forfeiture of $1,500 pay per month for one month and a reprimand for stealing from the base exchange. Courts-Martial A special court-martial found an airman basic from the 366th Fighter Wing guilty of violating Articles 120 and 125, under the Uniformed Code of Military Justice, for engaging in sexual acts with a minor between the age of 12 and 16 years old. The adjudged sentence included reduction to the grade of airman basic, two months confinement, forfeiture of $500 pay per month for two months and a bad conduct discharge. A general court-martial found an airman from the 366th CES guilty of violating Articles 86, 112a, 121 and 134, UCMJ, for being absent from duty, use of methamphetamine, stealing from the base exchange and breaking restriction. The airman was found not guilty of Article 112a, UCMJ, for use of marijuana and methamphetamine. The adjudged sentence included reduction to the grade of airman basic, 245 days confinement and a bad conduct discharge. A special court-martial found an airman 1st class from the 366th AMXS guilty of violating Article 112a, UCMJ, for using ecstasy. The adjudged sentence included reduction to the grade of airman basic, three months confinement and forfeiture of $400 pay per month for three months. A general court-martial found an airman 1st class from the 366th AMXS guilty of violating Article 134, UCMJ, for possessing child pornography. The adjudged sentence included reduction to the grade of airman basic, 20 months confinement, forfeiture of all pay and allowances and a bad conduct discharge. A general court-martial found a staff sergeant from the 366th AMXS not guilty of violating Article 120, UCMJ, for engaging in lewd acts with a child. Civilian Convictions The Ada County District Court found an airman 1st class from the 366th CMS guilty of disturbing the peace. The adjudged sentence included $225.50 in fines. The Elmore County District Court found a senior airman from the 726th ACS guilty of driving under the influence. The adjudged sentence included 60 days confinement with 55 suspended, $841.50 in fines and one year probation. The Elmore County District Court found a senior airman from the 366th SFS guilty of driving under the influence. The adjudged sentence included eight days confinement, $927.50 in fines and one year probation. The Ada County District Court found a staff sergeant from the 366th AMXS guilty of driving under the influence. The adjudged sentence included five days confinement with two days credited, $840.50 in fines and one year probation. Discharges An airman from the 366th SFS received an honorable discharge for failure to meet minimum fitness standards. An airman 1st class from the 366th AMXS received a general discharge for minor disciplinary infractions. A senior airman from the 366th AMXS received a general discharge for minor disciplinary infractions.
