Justice Report Published Nov. 18, 2009 366th Fighter Wing Legal Office MOUNTAIN HOME AIR FORCE BASE, Idaho -- The 366th Fighter Wing Judge Advocates Office recently released the following information on violations of the Uniform Code of Military Justice in October. Article 15 An airman first class from the 726th Air Control Squadron received nonjudicial punishment consisting of a reduction to airman, suspended forfeitures of $150 per month for two months, 15 days extra duty with an additional 30 days extra duty suspended and a reprimand for damaging government property and disrespect to a noncommissioned officer. An airman first class from the 366th Aircraft Maintenance Squadron received nonjudicial punishment consisting of a suspended reduction to airman, 10 days extra duty, and a reprimand for negligently failing to use the proper technical order to reinstall engine bay panels. An airman first class from the 366th Logistics Readiness Squadron received nonjudicial punishment consisting of a suspended reduction to the grade of Airman, forfeiture of $100, with an additional forfeiture of $100 suspended, 15 days restriction, seven days extra duty, and a reprimand for making a false official statement and not returning from leave when scheduled. A staff sergeant from the 366th AMXS received nonjudicial punishment consisting of reduction to senior airman, 15 days extra duty, and a reprimand for failing to ensure serviceability of servicing equipment prior to use, in accordance with technical orders. Court-Martials A special court-martial found an airman first class from the 366th Force Support Squadron guilty of violating Article 83, UCMJ, fraudulent enlistment, Article 86, UCMJ, absence without leave, Article 107, UCMJ, false official statements, and 112a, UCMJ, wrongful use of methamphetamine. The adjudged sentence included reduction to the grade of E-1, 75 days confinement with nine days credited and a bad conduct discharge. A general court-martial found a senior airman from the 366th Civil Engineer Squadron guilty of 12 specifications of violating Article 121, UCMJ, larceny. The adjudged sentence included reduction to the grade of E-1, 30 months confinement and a bad conduct discharge. Civilian Convictions The Ada County District Court found a senior airman from the 366th Medical Support Squadron guilty of driving under the influence. The adjudged sentence included fines of $732.50, and five days confinement. The Ada County District Court found an airman first class from 366th CES guilty of DUI. The adjudged sentence included a fine of $709.70 and five days in jail with one day credited and one year probation. The Ada County District Court found an airman from the 366th Equipment Maintenance Squadron guilty of DUI. The adjudged sentence included a fine of $590.50 and five days jail time with one day credited. The Ada County District Court found an airman first class from the 366th AMXS guilty of assault. The adjudged sentence included 90 days jail time with 87 days suspended. The Elmore County District Court found an airman first class from the 366th AMXS guilty of battery. The adjudged sentence included 90 days of confinement with 87 days suspended with one day credited, and a fine of $225.50. Discharges An airman first class from 366th Security Forces Squadron received an honorable discharge for an adjustment disorder. An airman from the 366th Component Maintenance Squadron received a general discharge for minor disciplinary infractions. A senior airman from the 726th ACS received a general discharge for a civilian conviction. An airman basic from the 366th AMXS received a general discharge for minor disciplinary infractions. An airman first class from the 366th AMXS received an honorable discharge for two CDC failures. An airman first class from the 366th CES received a general discharge for minor disciplinary infractions. An airman first class from the 366th EMS received a general discharge for minor disciplinary infractions. A senior airman from the 366th EMS received a general discharge for minor disciplinary infractions. An airman first class from the 366th AMXS received an honorable discharge for a personality disorder. An airman first class from the 366th AMXS received a general discharge for drug abuse. An airman basic from the 366th CMS received an "Under Other than Honorable Conditions" discharge for drug abuse.
