Justice report Published March 25, 2010 366th Office of the Staff Judge Advocate MOUNTAIN HOME AIR FORCE BASE, Idaho -- The 366th Fighter Wing Office of the Staff Judge Advocate recently released the following information on violations of the Uniform Code of Military Justice for the month of February. Articles 15 The 366th Security Forces Squadron commander vacated an airman basic's suspended punishment from an Article 15, UCMJ, imposing 30 days restriction to the limits of Mountain Home AFB for failing to go to his appointed place of duty at the time prescribed. An airman from the 366th Logistics Readiness Squadron received nonjudicial punishment consisting of reduction to the grade of airman basic, suspended forfeitures of $250 pay, 30 days extra duty with 15 days suspended, and a reprimand for failing to go to his appointed place of duty at the time prescribed. An airman from the 366th Security Forces Squadron received nonjudicial punishment consisting of reduction to the grade of airman basic, 30 days extra duty, 30 days suspended restriction to the limits of Mountain Home AFB, and a reprimand for transporting a loaded firearm, two false official statements, and theft of another airman's property. An airman 1st class from the 366th Aircraft Maintenance Squadron received nonjudicial punishment consisting of reduction to the grade of airman, 30 days extra duty with 15 days suspended, and a reprimand for underage drinking. An airman 1st class from the 366th AMXS received nonjudicial punishment consisting of a suspended reduction to the grade of airman, 30 days extra duty with 15 days suspended, and a reprimand for providing alcohol to a minor. An airman 1st class from the 366th Communications Squadron received nonjudicial punishment consisting of reduction to the grade of airman, suspended forfeitures of $150 pay per month for two months, 30 days extra duty with 15 days suspended, and a reprimand for failure to obey a no contact order and making a false official statement. A staff sergeant from the 366th CS received nonjudicial punishment consisting of reduction to the grade of senior airman, suspended forfeitures of $300 pay per month for two months, 30 days of suspended extra duty, and a reprimand for having an unprofessional relationship with a subordinate. The 366th Component Maintenance Squadron commander suspended a previously imposed reduction to airman for an airman 1st class who exhibited good behavior after receiving an Article 15, UCMJ, for being drunk and disorderly and damaging government property. The 366th Equipment Maintenance Squadron commander vacated an airman 1st class' suspended punishment from Article 15, UCMJ, imposing reduction to the grade of airman, and forfeitures of $250 pay per month for two months for misusing his government travel card. An airman 1st class from the 366th EMS received nonjudicial punishment consisting of a suspended reduction to the grade of airman, forfeitures of $150 pay per month for two months, 45 days extra duty with 30 days suspended, and a reprimand for failure to complete the motorcycle education course prior to driving a moped, reckless driving and child endangerment. An airman 1st class from the 366th Surgical Operations Squadron received nonjudicial punishment consisting of a suspended reduction to the grade of airman, forfeitures of $150 pay per month for two months, 30 days extra duty, and a reprimand for four specifications of assault and one specification of child endangerment based on the unsanitary conditions of his home. A senior airman from the 366th Civil Engineer Squadron received nonjudicial punishment consisting of reduction to the grade of airman, seven days extra duty, and a reprimand for breaking a no contact order and committing adultery. A senior airman from the 366th EMS received nonjudicial punishment consisting of reduction to the grade of airman 1st class, 45 days extra duty with 30 days suspended, and a reprimand for misusing his government travel card. A staff sergeant from the 366th EMS received nonjudicial punishment consisting of reduction to the grade of senior airman, 45 days extra duty with 30 days suspended, and a reprimand for failing to go to work, failing to obey a lawful order and one false official statement. A technical sergeant from the 366th Fighter Wing received nonjudicial punishment consisting of reduction to the grade of staff sergeant, suspended forfeitures of $500 pay per month for two months, and a reprimand for two specifications of sexual harassment against an airman. Courts-Martial A special court-martial found a senior airman from the 726th Air Control Squadron guilty of violating Article 112a, UCMJ, for use of marijuana. The adjudged sentence included reduction to the grade of E-1, four months confinement, and forfeiture of $250 pay per month for four months. A special court-martial found an airman basic from the 366th CMS guilty of violating Article 80, UCMJ, for wrongfully attempting to posses methamphetamine. The adjudged sentence included 10 months confinement, forfeiture of $964 pay per month for 10 months and a bad conduct discharge. Civilian Convictions The Ada County District Court found an airman from the 726th ACS guilty of public intoxication. The adjudged sentence included a fine of $140.50, and one day jail time with one day credited. The unit also issued a Letter of Recommendation, Unfavorable Information File, and placed the member on a control roster. The Elmore County District Court found a senior airman from the 366th EMS guilty of battery. The adjudged sentence included a fine of $497.50, 180 days jail time with 173 days suspended, two days credited and 10 days discretionary time. The unit also issued a LOR, UIF, and placed the member on a control roster. The Elmore County District Court found a staff sergeant from the 366th LRS guilty of DUI. The adjudged sentence included a fine of $835.50, 5 days jail time with one day credited. The unit also issued a LOR, UIF, placed the member on a control roster, and administratively demoted the member. The Mahoning County District Court in Ohio found a staff sergeant from the 366th EMS guilty of resisting arrest and criminal trespass. The adjudged sentence included a fine of $100, and two days jail time. The unit also issued an LOR and UIF.
